1. Acceptance of Terms
By accessing or using APX Haul ("the Service"), operated by APX Haul LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
APX Haul is a cloud-based customer relationship management (CRM) platform designed for hauling, junk removal, and dumpster rental companies. The Service includes job management, scheduling, invoicing, payment processing, driver mobile app, customer portal, marketing tools, and analytics.
3. User Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
4. Subscription Plans & Payment
The Service is offered under subscription plans (Starter, Pro, Enterprise) with monthly billing. Free trials may be offered. You authorize us to charge your payment method for recurring subscription fees. Prices may change with 30 days' notice.
5. Payment Processing
Payment processing is provided through Stripe. By using payment features, you agree to Stripe's terms of service. Processing fees vary by plan tier and are disclosed in your plan details.
6. Data Usage & Analytics
We collect usage analytics to improve the Service, including page views, feature usage, and session recordings. Error tracking data is collected automatically. See our Privacy Policy for details.
7. Your Data
You retain ownership of all data you input into the Service. We will not sell your data to third parties. You may export your data at any time. Upon account cancellation, data is retained for 90 days before deletion.
8. Acceptable Use
You agree not to: (a) use the Service for any illegal purpose, (b) attempt to gain unauthorized access, (c) interfere with the Service's operation, (d) send spam through our communication tools, (e) exceed reasonable usage limits.
9. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by factors beyond our control.
10. Limitation of Liability
To the maximum extent permitted by law, APX Haul shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
11. Termination
Either party may terminate the subscription at any time. We may suspend your account for violation of these terms. Upon termination, your access will cease, but your data will be retained for 90 days.
12. Changes to Terms
We may update these terms at any time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.
13. Governing Law
These terms are governed by the laws of the State of Arizona, USA. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
